Eric Clapton Will Not Pursue Fine from Woman Selling Bootleg CD

Eric Clapton’s representatives announced that the guitarist will not pursue the $3,500 fine ordered against a German woman who posted a Clapton bootleg on eBay. There was an uproar online when people found out that the woman posted the CD for just $11 dollars and would face six months in prison or a $283,000 fine if she left the post up, and additionally, she was responsible for paying for both party’s legal fees.
The statement was issued to Clapton’s fan club and helped to clarify the situation. His management explained, that Germany “is one of several countries where sales of unauthorized and usually poor-quality illegal bootleg CDs are rife.” They continued to elaborate saying, Clapton “and a significant number of other well-known artists and record companies” hired German lawyers located in the country to restrict the sale of the ripped CDs.
They went on to say that Clapton’s lawyers and management team are who identify if an item is illegal, not Clapton personally and that 95% of these cases are settled outside of Court. The purpose of these cases is to market active bootleggers, not individuals selling unauthorized CDs from personal collections.
They continued to address the case in their statement, “If the individual had complied with the initial letter the costs would have been minimal. Had she explained at the outset the full facts in a simple phone call or letter to the lawyers, any claim might have been waived, and costs avoided.”
“When the full facts of this particular case came to light and it was clear the individual is not the type of person Eric Clapton, or his record company, wish to target, Eric Clapton decided not to take any further action and does not intend to collect the costs awarded to him by the Court,” Clapton’s management said.
In lighter news, Clapton is spreading a little holiday cheer with a new single set to release on Friday titled, “Heart of a Child.”
